This Website (www.expensecheck.com.au) (Website) is owned and operated by Expense Check Pty Ltd (ABN: 34 163 634 946) (Expense Check). By accessing and/or using this Website and related services, you agree to these terms and conditions (Terms), and to our privacy policy available at https://www.expensecheck.com.au/privacy (Privacy Policy). You should review our Privacy Policy and these Terms carefully and immediately cease using our Website if you do not agree to these Terms.
In these Terms, 'us', 'we' and 'our' means Expense Check.
The words “you” in these Terms, including the Appointment for the Expense Check auto switching service below, means the person or the entity Expense Check is contracting with as registered with Expense Check, being the holder of the ABN provided to Expense Check at registration or updated within the Expense Check Website or otherwise the person identifiable by name and contact details.
If you are registering with Expense Check on behalf of a business, that business is taken to have accepted these Terms) and if applicable, the Appointment, and you are taken to have been duly authorised to bind the business.
Main things you should know:
You are responsible for ensuring that information you provide is accurate and complete, as this will affect your results.
Information provided by Expense Check about your future usage and, where you do not provide past usage data, your past and current usage is a guide only.
Not all supplier offers available to you may be displayed on Expense Check.
You should make your own inquiries about all plans that are suited to your needs and not rely on the information on Expense Check.
If you upload or otherwise use supplier data provided by your retailer or distributor for the purposes of using Expense Check, the company (and you, if you make any changes to the data), not Expense Check, is responsible for the accuracy of that data. Expense Check does not check that the data is correct or otherwise take any responsibility for the content of material provided to you by your company.
Any information about your past, current or projected future usage that you obtain through use of Expense Check is determined based on the information that you provide in response to questions. You are responsible for ensuring that the information that you provide is accurate and complete. The results provided by Expense Check are estimates provided as a guide only and, although Expense Check takes due care to ensure that the results are as accurate as possible, the results may not reflect your actual past, current or future usage. The information is not financial advice and may not accurately reflect the amount that you will pay.
Electricity
The information about available electricity offers is provided by electricity retailers to the Australian Energy Regulator (AER), and made available to Expense Check. The electricity retailer is required to ensure that information is accurate and current. Expense Check is not responsible for verifying its accuracy, currency or completeness and does not take any steps to do so. Accordingly, Expense Check does not guarantee the accuracy, currency or completeness of that material. If you wish to take up any offer listed in Expense Check, you should verify the details of the offer with the electricity retailer, including checking that the offer is available to you and all of the terms and conditions applicable to the offer. Expense Check cannot provide information about whether certain discounts or incentives are available to you, and does not calculate payments or credits from solar feed-in tariffs. You should not merely rely on the information provided through Expense Check as being correct, current and applicable to you or your circumstances.
The electricity offers displayed within Expense Check do not necessarily reflect all of the offers that may be available to you. There may be additional offers that are available to you but are from retailer that Expense Check does not have a relationship with.
You should check with the relevant electricity retailer what offers may be available to you, including offers not displayed as part of the results given by Expense Check.
The electricity offers presented are based on your current electricity usage over the weekdays and weekends (and may be an estimate only). If you are considering changing or adapting your electricity usage, these offers may no longer be the most appropriate.
The 'offer types' shown above contain offers for Flexible Pricing (Flex), Flat Pricing (Flat) and Time of Use (TOU). These are different types of electricity pricing structures. Note that Time of Use offers may not apply to consumers who are not already on a TOU plan. Please check with the retailer for that offer.

Displayed prices and costs are inclusive of GST unless otherwise stated.
Expense Check does not calculate payments or credits from solar feed-in tariffs. Information on solar feed-in tariffs may be found on your bill, in the offer details presented, or by contacting your retailer. Eligibility for solar feed-in tariffs should be confirmed with the retailer.
Expense Check only uses one 'controlled' or 'dedicated' load rate for the calculation of the Annual Estimate. Customers with complex arrangements will need to read the offer details provided and confirm with the retailer.
Registration
You must be a registered member to make orders, access our products and access certain features of our Website. When you register and activate your account, you will provide us with personal information such as your name and email address. You must ensure that this information is accurate and current. Refer to our Privacy Policy https://www.expensecheck.com.au/privacy for further information as to how we collect, use, handle and disclose personal information.
When you register and activate your account, we will provide you with a user name and password. You are responsible for keeping this user name and password secure and are responsible for all use and activity carried out under this user name.
To create an account, you must be:

at least 18 years of age;

possess the legal right and ability to enter into a legally binding agreement with us; and

agree and warrant to use the Website in accordance with these Terms.
For promotional purposes, we may display the usernames of the last few orders received. For example "John Smith just bought…". When registering and activating your account, we strongly recommend using a username rather than your full name if you do not want others to know what products you have ordered.
Collection Notice
We collect personal information about you in order to provide you with Expense Check’s comparison feature and for purposes otherwise set out in our Privacy Policy athttps://www.expensecheck.com.au/privacy.
We may disclose that information to third parties that help us deliver our services (including information technology suppliers, communication suppliers and our business partners) or as required by law. If you do not provide this information, we may not be able to provide all of our services or products to you. We may also disclose your personal information to recipients that are located outside of Australia, including to third parties located in the Philippines for data processing.
Our Privacy Policy explains: (i) how we store and use, and how you may access and correct your personal information; (ii) how you can lodge a complaint regarding the handling of your personal information; and (iii) how we will handle any complaint. By providing your personal information to us, you consent to the collection, use, storage and disclosure of that information as described in the Privacy Policy and these Terms.
Accuracy, completeness and timeliness of information
The information on our Website is not comprehensive and is intended to provide a summary of the subject matter covered. While we use all reasonable attempts to ensure the accuracy and completeness of the information on our Website, to the extent permitted by law, including the Australian Consumer Law, we make no warranty regarding the information on this Website. You should monitor any changes to the information contained on this Website.
We are not liable to you or anyone else if interference with or damage to your computer systems occurs in connection with the use of this Website or a linked Website. You must take your own precautions to ensure that whatever you select for your use from our Website is free of viruses or anything else (such as worms or Trojan horses) that may interfere with or damage the operations of your computer systems.
We may, from time to time and without notice, change or add to the Website (including the Terms) or the information, products or services described in it. However, we do not undertake to keep the Website updated. We are not liable to you or anyone else if errors occur in the information on the Website or if that information is not up-to-date.
Automated switching
By registering with or joining the Expense Check auto switching service you appoint Expense Check Pty Ltd (ABN: 34 163 634 946) of 99 Coventry Street, South Melbourne, Victoria 3205, as your agent and Expense Check accepts that appointment as agent on the terms and conditions set out in this paragraph (Appointment).

Under this Appointment, you understand and agree that Expense Check:

will choose and select a supplier or provider on your behalf and to switch you to a product to which you have authorised or requested us to switch you (i.e we will complete an application for a supply contract on your behalf with a provider we choose), where, based on the information you have provided to us under these Terms, the product or service will, overall, reduce your spending on that particular product at the time the switch is effected by us (for example over a two year contract with the supplier the product or service may be cheaper than a one year contract). This does not include any termination or cancellation fees you may have with your existing provider nor does it take into account any price increases the supplier may make from time to time.

will notify you by email as soon as possible once we have switched you. Expense Check does not exercise any cooling off periods on your behalf so you must consider whether the product or service to which you have been switched meets your requirements. If you wish to exercise any cooling off periods and/or cancel a switch under this Appointment, you must contact the supplier directly (at the details they provide you) and then notify Expense Check by email at [spence@expensecheck.com.au].

will not provide customer services or complaint services on behalf of a supplier or provider to whom you are switched.

will not switch you to a new product or service within 6 months of you having already completed a switch or entered into a new product or contract with a supplier under this Expense Check auto switching service.

You agree to not make any application for a comparable product independently of Expense Check, for so long as this Appointment is in place.

If there is a particular type of product, duration of product (for example if you do not want any long term or minimum term contracts to be entered into on your behalf) any quality or feature of product or supplier(s) you would like us to take into account, please immediately notify us by email at [spence@expensecheck.com.au]. Expense Check does not under this Appointment take into account the quality, identity of provider, suitability of product or supplier or any other factor other than pricing of the product or service to which you are being switched unless you have informed us of such requirement.

Expense Check may inform any suppliers of its status as your agent and use or provide such information as may be legally necessary in order for it to carry out the services or perform its obligations under these Terms and/or Appointment and you authorise Expense Check to use any of the information you provide us for the purposes of this Appointment, this includes but is not limited to personal information including your name, date of birth, address, phone number and any credit card details we may hold for you.

Expense Check is entitled to receive remuneration from its suppliers in relation to any products or supply agreements entered into or purchased by you under this Appointment. This will be payable by the supplier to Expense Check directly and may take the form of a commission or referral fee.

You may terminate the Appointment at any time in writing – you must notify us immediately by email at autoswitch@expensecheck.com. Any contracts we enter into on your behalf under this Appointment prior to receiving any email from you terminating this Appointment will be your responsibility.

You will indemnify Expense Check for any expense, cost, loss or harm suffered as a result of the Appointment, including but not limiting payment of all tax invoices for the products or services to which you are switched, any late fees, any cancellation fees or termination fees.

You warrant and represent that the information you provide us under the Expense Check auto switching service is true, accurate, complete and correct. You will notify us of any changes to such information immediately by emailing spence@expensecheck.com.au.

You should always consider whether the products to which you have been switched are suitable for your needs and meets your requirements or satisfaction.

This Appointment commences the date you join or register with the Expense Check auto switching service and may be terminated by either Expense Check or you at any time by giving each other notice in writing at the the email address you have provided to us and in the case of Expense Check, by emailing us at spence@expensecheck.com.au.
Promotions and competitions
For certain campaigns, promotions or contests, additional terms and conditions may apply. If you want to participate in such a campaign, promotion or contest, you need to agree to the relevant terms and conditions applicable to that campaign, promotion or contest. In case of any inconsistency between such terms and conditions and these Terms, those terms and conditions will prevail.
Purchases
IN AUSTRALIA, OUR GOODS AND SERVICES COME WITH GUARANTEES THAT CANNOT BE EXCLUDED UNDER THE AUSTRALIAN CONSUMER LAW. NOTHING IN THESE TERMS AND CONDITIONS PURPORTS TO MODIFY OR EXCLUDE THE CONDITIONS, WARRANTIES AND UNDERTAKINGS, AND OTHER LEGAL RIGHTS, UNDER THE AUSTRALIAN COMPETITION AND CONSUMER ACT AND OTHER LAWS. ANY AND ALL OTHER WARRANTIES OR CONDITIONS WHICH ARE NOT GUARANTEED BY THE AUSTRALIAN CONSUMER LAW OR THE COMPETITION AND CONSUMER REGULATION 2010 ARE EXPRESSLY EXCLUDED WHERE PERMITTED, INCLUDING LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES CAUSED BY BREACH OF ANY EXPRESS OR IMPLIED WARRANTY OR CONDITION.

Jurisdiction and governing law
Your use of the Website and these Terms are governed by the law of Victoria and you submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in Victoria.
